White-collar crime is not prosecuted with any adequacy in this country. Racketeers, money launderers, high-class thieves are allowed to defraud the country; the state, local government, individuals, corporations, everyone is fair game. If caught, at most there is a fine, generally a slap on the wrist. Don’t get caught next time is what that fine says.
I am being sued for defamation by a white-collar criminal who has destroyed my property in collaboration with state and local government agencies and an insurance company. Prior to this shakedown, I was being ripped off by a bank in Texas!
To whom does one report white-collar crime? How many people have to know of the occurrence before taking action to end it?
Corporate totalitarianism is making me very ill.
When Vince Paglia, president of Protech Construction, and Nichole/Nahal Mazandarani, a senior adjuster at Safeco Insurance, came to my home to discuss the timetable of repairs, I thought they had been sent to repair the damages to my bedroom, caused by a tree limb falling on my house on Earth Day, 2016.
It took Safeco 19 days to respond to my claim that I entered 15 minutes after it happened. Trevor Haaswyk was the adjuster who responded and he sent an appraiser and an engineer to my home to assess the damages. The first adjuster responding requested the engineer’s assessment as he could not assess any structural damage that was not readily visible. The engineer assessed the damages and wrote a report that totaled the damages at around $48K. There was no damage to my storage/workshop, no damage to any other room in my home except the bedroom. The bedroom definitely suffered structural damage, but because my home was handbuilt in 1923, it withstood the weight of the wild pecan tree that fell on it. If you know anything of wood, you know pecan is dense and heavy.
When Mazandarani shows up with Paglia, they told me repairs could not commence because I had no foundation. The entire house would have to be rebuilt. Mazandarani called me a couple of days after this pronouncement to tell me the rebuild had been approved. They would begin after Paglia returned from his vacay in Croatia. He said he would start with the “garage”.
There was never a garage on this property. There was a workshop for metal and woodwork that I expanded to accommodate storage needs. When we needed off-street parking, the drive in front of the house easily accepted two full-sized vehicles. No matter how often I said I didn’t have a garage and didn’t want my workshop torn down, as it wasn’t damaged, I was told that LA County Building and Safety and Planning required me to have a garage and covered parking. A driveway had to reach from the sidewalk to the garage.
This scheme to rebuild my home with only an authorization for repair was signed off on at every instance of money disbursement by Kent Stiles of Safeco. Stiles took over my claim from Trevor Haaswyk and would never answer me when I asked what happened to Haaswyk’s findings.
I have been suspicious of the behavior of my insurance provider and their contractor since March 2017. By then, they had surpassed the 3-6 month time estimate in the “contract” I signed with Protech. I felt I was being subjected to bad faith. It took quite some time to find the department to report problems with claims, but I was told the Presidential Service Team could assist me.
Through first Fernando Moreno and then, Olivia Casarez, both of the PST, I was subjected to further stalling and attempts to call me off the complaint. Ms Casarez would report everything I said to Kent Stiles, who would then alter his documentation to counter whatever my complaint may have been. Ms Casarez openly mocked me when I suggested an audit needed to be done on all claims handled by Stiles. He is much too practiced at covering up, stalling, making paperwork, like police reports, disappear. The narrative that had included rebuild suddenly went to repair only, and it was as if Protech had not been the one to rebuild this house, but came in only to make repairs about items I said were missing or never installed on this site. This is not the first time a consumer has been subjected to this skimming scam, this fraud, that seems to be a systemic failure of Safeco Insurance.
Throughout the process, I noticed there were never any plans drawn for a rebuild, that the contractor was building the house from a poor drawing of my home that didn’t take into consideration the angle at which my lot lies. And that is only the first of many wrongs that occurred here.
The trap pictured above was put in as a replacement for my handbuilt 1923 Rambler. It is not up to Code, yet it passed inspection. It lacks a back door, venting, access to the crawlspace or attic, my recessed lighting, my shelves, a closet, a mirror and vanity in the bathroom; to list more would bore you. The fact that they effectively killed all of my flora, and my library, that they destroyed my kitchen with its built-in, floor to ceiling shelves, I will never get over. I’ve been stuck in this trap a year and still cannot use my stove because there is no connector to the gas line.
Move-in ready. I’m supposed to be grateful for a “brand new house” according to Mazandarani. The project was abandoned when I walked into it. When the Porta Potty is gone, the project is done or abandoned. It looked abandoned to me, having no fencing, no porch, not even a real step, only a plywood board in front of the only entry or exit from this junk.
I want this house torn down. I had no choice in it, was lied to about it, had my home of 60 years taken from me. I now have a property that is worth less, taxed higher, is smaller, and in no way suits my needs. Much of my property that was in storage stands outside because I cannot fit it into the house or the garage. If everything came out of my home, why can’t it go back in?
Most disturbing is that Kent Stiles has been investigating himself. No matter to whom I reported the fact that he was robbing me, everything comes back to Stiles. He has no manager, no supervisor. Neither CEO of Safeco or Liberty Mutual seem interested in knowing they have an embezzlement ring in their Claims department. I think I have spoken to no less than 20 people at Safeco about this matter. Stiles had a security block on my file to prevent any one other than himself from seeing my claim file. The Presidential Service Team is a joke. Consumers should not be subjected to this treatment. Don’t insurance companies have a fiduciary responsibility to their customers? Guess not.
Well, well. As Safeco hired the Independent Inspector, I expect to never see his report. When he presented himself here, he seemed fair and even-handed, I might even say fair-dealing emanated from him. I must be radiating some sort of freneticism because all men wind up talking to my son. I think they hear me, but they talk to him. At first I rather despised this male habit, but once I rethink it some more, I’ll get back to this line.
For six months, we have been glamping, with the boxes that have no where to go gracing the “driveway” and the “back yard” with their unexamined contents. After opening 400 boxes on the dead run, I hadn’t the manual dexterity to continue. Gotta rest that carpal tunnel, doncha know?
No stove hookup available, no flex line and cut-off valve. But this was paid for. So, I bought some electric burners and have been cooking with electricity. Hate it.
The meter board should have arc faults in it. They were removed by Protech’s electrician when I called to tell them the breaker was thrown when nothing much was on. I think the place needs rewired. Their fix was to remove the Building Code-required arc faults.
The adjuster who made the payments, Kent Stiles, continues to head up the investigation into my claims of his, Mazandarani’s, and Protech’s malfeasance. How can he investigate himself? I asked him this directly. He provided no answer. I had the opportunity to ask his manager, and he said Safeco thought he was the best person for the job because of his “familiarity” with the case. The man has participated in my gaslighting for over two years, masterminded the situation IMO because he is the common denominator among all adjusters who have worked on this case. Stiles took over the case from Trevor Haaswyk, who later left the state. Stiles made the payment to Beal Bank. He made the $80K payment to Protech in March even though he knew full well the job was in active dispute. I used his estimate to craft the police report itemized list of items stolen from my property. Safeco paid for all sorts of things after Protech provided them with a written estimate. Not a final bill. No invoices. An estimate, only, after two years. At this point, some precise figures should be available.
But, no. After submitting this $80K estimate to me, Protech issued ANOTHER ESTIMATE, that stated they spent $238K on this project. Again, what was installed was altered, costs changed, still no receipts or invoices presented, no explanation of the change in cost from their original “bid” of $190K to the final $238K. Stiles is the only one qualified to investigate these irregularities as he aids and abets grand theft. SMH
After six months of wrangling with Safeco Senior Claims Resolution Specialist Kent Stiles, whom I fired one month ago, enduring his continued attempts to humiliate and abuse me, his attempt to go through the back door of Innovations Properties to get me hooked up with the contractor network that I thought I was already a part of, an independent cost consultant was called in.
Stiles did not want him to know about the 19 days of delay that characterize the first days of my claim that was handled by a fellow named Trevor Haaswyk, now employed elsewhere. Wonder if I should track him down and get a statement? I may present this in civil court if this matter is not resolved to my satisfaction.
The inspector was treated to a first-eye look at the hideous workmanship that is Protech’s signature if all of the online reviews are to be believed. He photographed the overtorqued roof that is twisting the house and causing the apex joint in the centers of the house and garage, front and back, to separate and jut forward and backward. He saw how they deviated from the “plans”, a different set than those presented to me over 18 months of deceit.
The inspector also had a look at the last estimate submitted, documenting that Protech claims they were paid over $238K when their initial bid was $190K. They submitted no paperwork indicating why they needed this extra money. I have no documentation in this house for anything installed, no warranties for appliances installed, and a previous estimate that netted Protech $80K. That estimate was not presented for inspection. Guess the State Contractors License Board will have to take that into account.
I know the inspector found we were charged for items and services that never happened or were never installed on this property. I know he took note of the shoddy workmanship in evidence.
In conversation with the State Contractors License Board, I learned that the relationship between a contractor and insurance adjuster is private, that no one is privy to what goes on during the claims process between them. This characteristic of the claims process works against the consumer, as I am a living example.
Protech did everything to make the outside of the building look good, but it is deteriorating before my eyes. They provided no invoices, receipts, warranties, or any other documentation to go with the objects installed in this house. There are fire sprinklers in here about which I have no clue.
The floors are allegedly oak hardwood. I was told to choose laminate because hardwood was too expensive and I had to be mindful of my budget. I never could get a number figure as to how much was in my budget, but found out later that there was $80K remaining in the account. This was paid out to Protech in a mad rush, in the midst of dispute, with the work undone. They didn’t have time to vent the house, the electrical needs rewiring. There are two vent-free, infrared heaters in here somewhere, but I see only a gas heater.
My kitchen is set up in such a way as to prevent my safe use of the stove. Gas lines installed where they are unneeded. I have not had full access to my kitchen for 5 months. Kitchen cabinets were only installed last week, yet they were listed as items bought and paid for on the estimate presented to Safeco for payment. Everything completely unverified, yet paid for, in full. Astonishing.
Frames were not removed, but left to rot underground. The water filter, connected only to the hot water even though it was billed as a whole house filter, had no filter in the canister. The contractor locked the tool in between pipes and told me he couldn’t remove it without turning off the gas. He stuck with this lie for weeks, then came and freed the tool without turning off the gas. Next, he tried to stop us from looking at the filter by saying there was no need to open the canister. Nevertheless, my son opened the canister and this is when we saw there was no filter in it.
The fencing is poorly done and every metal thing on the place, including the security door and the fencing is of poor quality, no comparison to what existed here before. I had hardwood floors, recessed lighting, the most beautiful and pollinator-inviting yard you ever saw. Protech destroyed it and left this cheap junk in place of my handbuilt, 1923 Rambler.
I suspect none of the appliances installed are new. Everything with a date on it comes from 2015. There are no invoices or receipts to prove differently. This house was built as a flip house. This is business?
Kent Stiles, Nahal Mazandarani of Safeco and Liberty Mutual, and Vincent Paglia dba Protech Construction, conspired together to defraud me of an, as yet, undetermined amount of money, two years of my time. They are responsible for the construction of a house of disputed quality, that develops problems daily.
Someone needs sued.
General Counsel for Beal Bank, Grant Hamilton, was wrong. I did, and continue to have something coming, you schmuck.
I received twice as many checks and twice as much money as was proffered before. Of course, no interest was paid. Also received the original Trust Deed document with the promissory note, stamped PAID IN FULL. That was exactly what was supposed to have happened 10 months ago when this debt was paid by confiscation of my homeowners insurance claim funds, which I expect to have returned.
One reason for the return is the court documents claimed I owed one amount and Beal Bank took twice that amount from funds to which it had no right.
Second reason for return is Beal Bank has provided no evidence that they had a right to those particular funds, that were made out to me and MGC Mortgage, Inc. MGC Mortgage had commandeered my insurance because they noticed the name on the insurance did not match the name on the mortgage–a decade later they notice this. To make the names match, they listed the mortgage as the Estate of my Mom, and said the payment came from that Estate. Trouble is, the Estate has been closed for two years. They knew this, but Beal Bank, who I had no idea was involved with my property in any way, filed foreclosure against the property anyway, citing a Trust Deed. Had the Trust Deed been in effect, it would have been mentioned during probate. It never was because the TD was not in effect for non-Californians. Says so right on the front page. Also states that whoever holds the TD can be held liable for claims against the holder should they violate stipulations. I feel violated.
Beal Bank certainly had no right to take the money and it had no right to cloak the payment under the Estate as it has been closed for two years. Why I got two years worth of property tax refunds.
My attorney failed to report the payments to the court, failed to report that Beal Bank was paid off before the case was confirmed, failed to be ethical.
I have been robbed of 47,810.92 American dollars by Beal Bank. My home was razed and that money was to pay for repairs. My name was on the check because I pay the bill for the insurance, have done for a decade.
Beal Bank is busier than a cat covering it up, desperately denying any knowledge of what their “affiliate” is up to, as if it isn’t up to doing Beal’s dirt.
Betchu know what is going on now, Grant Hamilton, General Counsel for Beal Bank who is most unprofessional, unethical, and quite possibly criminal in his defense of Beal Bank.
I have now received two acknowledgement letters from Beal Bank. All sorts of acknowledgement, but none of my cash.
Gaslighted for more than ten years, made to pay a mortgage I did not owe nor own. Wrongfully foreclosed against my property. Forced me into bankruptcy. I believe they bribed/threatened/paid off my bk attorney because he let Beal Bank’s claims go unchallenged, up to and including when they stole my homeowner’s insurance claim funds, cloaked the theft under the cover of a nonexistent Estate, and provided no accounting and no prommissory note plus original Trust Deed.
Counsel for Beal Bank filed a falsified document with the federal bankruptcy court, asserting their right to foreclose on my property based on a secured trust deed … that was fully reconveyed in … 1997.
The purpose of probate is to establish clear title to real property. If an active trust deed existed on the property, it would have been unearthed through the probate process.
Beal Bank ignored the probate results, that awarded title to me, free, clear, and uncontested, and proceeded with their wrongful foreclosure.
Also, Beal Bank, through their falsfied document have accepted responsibility for making me pay for a mortgage that was not mine for 10 years.
Waiting for the BK court to tell me something, but have to wait until April.
I think I am owed some money.
