Beal has been Paid (Real/Real)

Insurance proceeds totaling more than the amount demanded by Beal Bank/MGC Mortgage, Inc. have been received by the bankruptcy department in Lake Zurich, IL, original handler of my mortgage payments, loan modification requests, originator of requests for Affidavits of Heirship and directions to get title to the property without ever    mentioning probate.

As MGC  Mortgage, Inc. is listed as a lienholder on my homeowner insurance, the checks are made to both of us. I had to endorse the checks and send them to Beal Bank as bankrutcpy payments. It is allegedly illegal for them to take the monies and leave me high and dry for repairs to my home. I want them to continue breaking the law as with them I want no further truck.

However, I expect them to come up with some trick to keep me in bankruptcy and under their thumbs until Rapture. They have managed it this long, portraying me as the irresponsible, underhanded one who failed to report my mother’s death to them until I filed probate. They also claim that they have held this loan from 2003, two years before my mother’s death. These claims are in the court documents, made by attorneys for Beal. In documents from MGC to the FDIC, they admit they had knowledge of my mother’s death from 2008. This makes sense as I paid two other companies for this loan before I began paying MGC Mortgage in 2007-8. Nevertheless, I’m the lie and Andrew Beal is the rich, pretty boy.

These Are the Facts (Real/Real)

It took 18 days for my insurance company to respond to my claim. Seems the mortgage company called and changed the pay arrangement I’d made with the insurance company 5 years ago to deduct my insurance payments directly from my bank account. The mortgage company is alleged to have stated they were opening an escrow account and would be paying the insurance from now on. Then, when the bill went unpaid for a couple of months, I received a warning letter that the insurance would cancel shortly. Well, bafflement aside, I paid the insurance in full so that there should be no more problems until time to renew, which is coming soon.

Beal Bank is claiming their interest in the property is not protected by an adequate equity cushion. Wonder what that means as I owe only $44,185.85 as of 7 June 2016 and there is four times that much equity in the property AND the insurance is covering the claim, which will increase the value of the property.

Beal Bank claims they will reach out with possible loan modification options, but we have been over that ground before. Besides, they do not handle home mortgages, according to their Plano TX office and I have already been denied loan modification twice by MGC Mortgage. This backhanded, iffy offer is conditional upon the BK court lifting the stay to foreclose on the property.

Beal Bank will stop at nothing in its attempts to wrest my home from me.

This is what a senior can expect. This is what a veteran can expect. This is what a college graduate can expect.This is what one disabled can expect. This is what the remnants of the middle-class can expect: What you have worked, sweated, struggled, and sacrificed for can be taken away from you, no matter all your playing by the rules, by a corporate entity that can hide behind the law and paperwork. The agencies that are supposed to look out for the consumer are in conflict of interest situations with the oppressors. For example: Beal Bank v FDIC.

There is a 2009 article by Tyler Durdan on the Hypocrisy of the FDIC that I cannot bring up right now, but I will continue to hunt it as Beal Bank is featured in the article.

I have no idea how things are going to turn. After suffering what felt like strange treatment from my insurance company, things have turned there. Seems I had a crooked contractor. His major interest was in money. He was shady from the start, suggesting I move and store my own furniture and pocket the money. Cray-cray. You should have seen my new adjuster swoop in and slay the dragon who lied, came unprepared and incorrect for a woman on her job, a woman of distinctive family heritage, with a good name known for many generations. It was thrilling to watch her work, exposing what I think would have been considered fraud. It is so unfortunate that one cannot conduct business with African-Americans any more. Always come shady lately, if they come at all.

Banksters vs Hamilton: The Latest (Real/Real)

Filed complaints with Better Business Bureau, Consumer Affairs, CA State Department of Business Oversight, and the young Consumer Financial Protection Bureau http://consumerfinance.gov. I also wrote to Senator Elizabeth Warren as I know her to be a consumer advocate and quite involved in the formation and operation of the CFPB.

My representative from Consumer Affairs had to negotiate with MGC Mortgage, and it was not a pretty affair, but he gained my side a month’s reprieve, in which time MGC Mortgage is supposed to review the loss mitigation documents I submitted. I expect for them to come back with a denial and some excuse that would prevent me from qualifying for loss mitigation, and I’ll be told to do something else. They denied a loss mit app in November 2014 and told me I was not eligible for a loan assumption, though the word lately has been loan assumption whenever I’ve been able to speak to an MGC representative.

Now, thanks to the helpful input of friends and several agencies, I’m on a mission to find the $42,000 owed these people on a $25,500 loan taken out in 1997! Go figure. Maybe I’ll put my GoFundMe page back up…

Simplest way to amend the Probate Code to avoid any more of this type of backdoor theft of real property from consumers by banksters would be to require ALL creditors to make a claim against the Estate of a deceased mortgageholder, thus also requiring all creditors to inform the consumers who notified them of the mortgageholder’s death of their possible need to file probate. Both secured and unsecured creditors should be held to the same standards when a deceased mortgageholder is involved.

Learning Curve of the Perplexed (Real/Real)

Finally, spoke with attorney who put my understanding straight. Mortgage companies do not have to tell you to file probate. They only have to collect their money because they are a secured lender. They just get their money or do what they are doing to me, selling the property.

I will have to assume the loan, but now that the balance is 3x what it was before this foreclosure started, I still feel ripped off, but the mortgage company has done nothing wrong. How can this be right?

Since no one is required to tell heirs what should be done when dealing with mortgage companies, particularly ones that do not communicate any info other than where to send the payment, a manual should be created to inform consumers of what basic steps can be taken to protect our interests and save our property from seizure through questionable business practices.

There oughta be a law requiring financial institutions to inform people of steps they should take after the death of a parent who leaves real property. The fate of our inheritances should not rest on the caprice of a moneylender.  Secured lenders should be required to file claims against Estates just like unsecured lenders, and they should have to do it in a timely fashion.

What has happened to me should not happen to anyone else just because they have no money and cannot hire an attorney.

Well, off to find some cash….

Reflections on Time

60 is fast approaching. I have no idea of what it is I am supposed to do once I meet this fated age. I don’t feel 60. I don’t look 60. I don’t think 60, except for my understanding and ruminating all over history, and my memories of how things once were.

What is commonplace that was uncommon back in the day? Violence is still the same, more common than ever. Civility is a thing of the past. Disrespect of women was somewhat less common. I remember when Black men treated all women as sisters and looked out for us and the entire neighborhood. That was in the time of Black Panthers. They provided free breakfasts, education, and other community activities intended to foster unity and a sense of family.

This is the most lackluster Black History Month I have ever experienced. The only new information I gleaned was from the Pacifica Network, KPFK. I learned about the great opposition MLK faced at the end of his life. 55% of Black folks disapproved of him because of his stances on war and poverty. Imagine. This is the 50th anniversary of Brother Malcolm’s death.

Can’t say that lies are any less prevalent. Neither is hate. Ignorance and stupidity are in staggeringly great supplies. Sometimes I can’t determine if there is more of the latter than there was before. There seems to be more cunning and cupidity in the works. I am not satisfied with the state of the world. I never expected such dysfunction.

Children are much more sexualized and exposed to sex and violence at extremely alarming rates. Everyone is stuck in the palms of their hands, even while driving. We are much more vulgar and coarse than we have ever been.

Health care is the pits. I miss being able to choose my own doctor, develop a relationship with my own doctor, and pay my own doctor without having to depend on an insurance company to act as go-between. It is only now, after several years of seeking a diagnosis for what I suspect is an autism spectrum difference, that a psychiatrist finally heard me and gave me a preliminary scale to complete. There were 50 items. The cut-off for likely having an AS difference was 32. My score: 45. The doctor also told me that the medical power structure did not want to diagnose me because of my age…. Seems to me that if we want to help these young people coming up in droves with autism, we ought to study those of us who have aged through before there was a name, other than weirdo or eccentric, for those of us with the glorious difference. We’ve got some knowledge to drop on those coming behind us. I pray our numbers increase rapidly. We are in need of a major paradigm shift in our ways of being.

It took a heap of living to get to 60. Never expected to get here given the way folks around me seemed to drop like lead weights. Death has always fascinated me and I began obtaining and storing obituaries when I was quite young. Such wonderful short stories that sometimes speak volumes with the information that is omitted about the deceased. I’m examining a data set of my own compiling that is composed of markers indicating the level of involvement, connection, and interaction with society that the deceased cultivated in life. I want to know if those who live longest were more invested in the process of living. Does social connectedness really contribute to a longer life? Is it the quality of the connections that matter? The number? My base interest is with the concept of excess death. Go look that up.

I’m happy to be getting older, but I definitely want to make a change in my world, immediately and on down the line. Things cannot go on as they are forever. The decimation of the middle class has been going on for the last 40 years. What a good ride downhill, Workers. Doctors are no longer gods, but working stiffs who have to answer to the insurance companies. Unions are nearly defunct. We, the people, who are supposed to be the government, are being ill-served by those lawyers in Congress. I’m not feeling this perpetual war stance we’re taking. I am sick of all sports. Spend billions on stadium building, but do nothing for homeless veterans, homeless families, homeless mentally ill, homeless victims of domestic violence. We spend $62,300 to incarcerate someone in California, but only $9100 to educate that same somebody. The prison-industrial complex gets rich and Congress wants to block immigrants from staying in this country. Hell, without them, who will pay into the Social Security system? Able-bodied black, brown, and white people are locked up, likely never to earn a decent living, likely unable to adequately care for their families. Somebody’s gotta keep the ship afloat.

Gotta go ponder some more. Turning 60 ain’t no sissy sprint, I’ll tell you what.

Old People Better Stand Up

Tired of old people, older people, being ignored in the drive to the future. Those of us over 50 have a whole lot to give to our culture and the world. All this focus on K-12, all the rhetoric breathed and theory advanced, well and good, but any society that fails to provide accessible opportunities for continual skills development and general knowledge acquisition to all her citizens is a society doomed to fail shortly. Wasting human capital is a moral and practical failing of our corporate capitalist materialist consumerist economy. The effects can be observed from slavery to the current day, just different demographics are involved.

We need a paradigm shift when examining the stages of adult life considering some trends in increasing longevity. Many of us over 50 are healthy, clothed in our right minds, and eager to share and savor life, using our skills and insights in concert with others to accomplish goals and improve our world for ourselves and the coming generations.

Why does our culture persist in denying older people a right to expect anything other than marginalization? We, the older, need to speak up and get ours, too.
